PRIVACY POLICY

We protect your personal information that you provide to us using industry-standard safeguards. We only share your information with your consent or as required by law.

 

1. What information we collect

Our Privacy Policy applies to anyone with a ServeBartendCook account.

When you create an account with us, you provide us with information (including your name, email address, and password) that we use to offer you a personalized, relevant experience on ServeBartendCook.

 

A. Registration

 

JOB SEEKER:

 

To create an account on ServeBartendCook you must provide us with your email address (which will be used as your login username) first name, last name, zip code and a password. You may optionally provide a contact phone number during initial registration.

In order to utilize ServeBartendCook to find job openings, you will need to complete a Profile. At a minimum, you will need to add at least one “Skill” and one “Specialty” to your profile by following the steps provided in the “Profile” section of the account. Additionally, you may optionally add descriptions of your experience regarding each skill or specialty, past employment information and any certifications, degrees or awards to further aid ServeBartendCook in finding open jobs that match your qualifications.

This information will only be seen by employers from whom you request an interview.

 

EMPLOYERS:

 

To create an account on ServeBartendCook you must provide us with an email address (which will be used as your login username) first name, last name, company you represent, your position within that company and a password.

In order to utilize ServeBartendCook to post a job and find qualified candidates you will be required to enter details about each establishment for which you will be hiring. You will need to provide a name for that location, a physical address, and the type of business (selected from a drop down list). Optionally, you may provide a website as well.

When posting a job, you will be required to provide general details about the job itself which include required skills and specialties (chosen from lists provided), a general description of responsibilities and requirements, whether the position offers benefits, whether the position is full time, part time, or temporary and compensation details.

All of your profile, establishment and job details will be viewable by any member who is matched with your job post.

 

B. Cookies

We use cookies and similar technologies, including mobile device identifiers, to help us recognize you, improve your ServeBartendCook experience, increase security, measure use of our Services. A cookie is a small piece of data that a Website transfers to your computer's hard disk to allow the server to distinguish your session from that of others while you are connected. Requests to send cookies are not designed to collect information about you, but only about your "browser session." You can control cookies through your browser settings and other tools.

 

C. Other

ServeBartendCook is an evolving web application. We are always working on ways to improve all aspects of the site to offer you more efficient and effective services. We often introduce new features, some of which may result in the collection of new information. Furthermore, new partnerships or corporate acquisitions may result in new features, and we may potentially collect new types of information.

 

D. Advertising

SBC Industries LLC is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to amazon.com.

 

Like most websites, we use automatic data collection technology when you visit or use the Platform to collect information that identifies your computer or device. This comprises information about your operating system, your IP addresses, browser type and language, referring pages and URLs, keywords, date and time, and what sections of our Platform you visit, as well as the universally unique ID (“UUID”), advertising identifier (“IDFA”), MAC address; operating system and version (e.g., iOS, Android or Windows), carrier and country location, hardware and processor information (e.g., storage, chip speed, camera resolution, NFC enabled), network type (WiFi, 3G, 4G, LTE), and similar data (collectively, the "usage information"). We collect this usage information by using cookies. Cookies are small packets of data that a website stores on your computer's hard drive so that your computer will "remember" information about your visit. You can reject cookies by following the directions provided by your browser vendor or by your Internet provider's "help" file. If you reject cookies, you may still visit and use the Platform, but may not be able to use some areas of our Platform. We use cookies (and the usage information collected) to help us identify you and analyze how you use our Platform. We also work with trusted third party partners which use cookies to collect usage information about how users use our Platform, for example, which pages users go to most often, and if they get error messages on those pages. The trusted third parties we currently work with include the following (click on the links to view these organizations' privacy policies and find out more about what data they hold about you, what they do with it, and how to opt-out from certain data collection):

We may share Other Information about your activity on the Platform with third parties for the purpose of tailoring, analyzing, managing, reporting, and optimizing advertising you see on the Platform and elsewhere. These third parties may use cookies, pixel tags (also called web beacons or clear gifs), and/or other technologies to collect such Other Information for such purposes. Pixel tags enable us, and these third-party advertisers, to recognize a browser’s cookie when a browser visits the site on which the pixel tag is located in order to learn which advertisement brings a user to a given site. We also use one or more third-party remarketing and conversion tracking services (including Twitter and Google Adwords) to advertise to users of our Platform on third party websites. These third-party service providers use cookies to serve ads based on a past visit to our Platform. Any data collected by such third party service providers will be used in accordance with this Privacy Policy and the privacy policy of such third party services provider. The third parties that are currently providing us with these services are listed below; for more information on these third party service providers, including how to opt out from certain data collection, please see below:
      - For Google Adwords, you can set preferences for how Google advertises to you using the Google Ad Preferences page, and if you want to you can opt out of interest-based advertising entirely by cookie settings or permanently using a browser plugin.

Certain features and functionalities of the Platform are based on your location. In order to provide these features and functionalities while you are using a mobile device, we may automatically collect geolocational information from your mobile device or wireless carrier and/or certain third-party service providers. Collection of this information occurs only when the Platform is running on your mobile device. You may decline to allow us to collect such information by adjusting your browser settings, in which case we will not be able to provide certain features or functionalities to you.

 

2. How we use your personal information
When you join ServeBartendCook, you acknowledge that information you provide on your profile can be seen by others and used by us as described in this Privacy Policy and our User Agreement.

 

A. Consent to ServeBartendCook Processing Information About You

The personal information you provide to us may reveal or allow others to identify aspects of your life that are not expressly stated on your profile (for example, your picture or your name may reveal your gender). By providing personal information to us when you create or update your account and profile, you are expressly and voluntarily accepting the terms and conditions of our User Agreement and freely accepting and agreeing to our processing of your personal information in ways set out by this Privacy Policy. Supplying information to us, including any information deemed “sensitive” by applicable law, is entirely voluntary on your part. You have the right to withdraw or modify your consent to our collection and processing of the information you provide at any time, in accordance with the terms of this Privacy Policy and the User Agreement, by changing your profile.

We communicate with you using email, and other ways available to us. We may send you messages relating to the availability of the Services, security, or other service-related issues. Email sent over the Internet is not secure and should not be used to communicate confidential information to us. Please be aware that we cannot guarantee the confidentiality or security of any information you send to us over the Internet when using email. We shall not be liable for any breach of confidentiality resulting from such use of email via the Internet.

 

B. Compliance with Legal Process and Other Disclosures

It is possible that we may need to disclose personal information, profile information, or information about your activities as a ServeBartendCook Member when required by law, subpoena, or other legal process, or if we have a good faith belief that disclosure is reasonably necessary to (1) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (2) enforce the User Agreement, investigate and defend ourselves against any third-party claims or allegations, or protect the security or integrity of our Service; or (3) exercise or protect the rights, property, or safety of SBC Industries, LLC, our Members, personnel, or others.
If there is a change in control or sale of all or part of SBC Industries, LLC, we may share your information with a third party, who will have the right to use that information in line with this Privacy Policy.

 

3. Your Choices & Obligations

You can change your ServeBartendCook information at any time by editing your profile, or by closing your account. You can also ask us for additional information we may have about your account.

 

A. Rights to Access, Correct, or Delete Your Information

You have a right to (1) access, modify, correct, or delete your personal information controlled by ServeBartendCook regarding your profile, (2) change or remove your content. You can also contact us for any account information which is not on your profile or readily accessible to you.

We keep your information for as long as your account is active or as needed. For example, we may keep certain information even after you close your account if it is necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes, prevent fraud and abuse, or enforce this agreement.

 

B. Data Retention

We retain the personal information you provide while your account is active or as needed to provide you services. We may retain your personal information even after you have closed your account if retention is reasonably necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes between Members, prevent fraud and abuse, or enforce this Privacy Policy and our User Agreement. We may retain personal information, for a limited period of time, if requested by law enforcement. ServeBartendCook Customer Service may retain information for as long as is necessary to provide support-related reporting and trend analysis only, but we generally delete closed account data consistent with Section 3.A., except in the case of our plugin impression data, which we de-personalize after 12 months unless you opt out.

Please respect the terms of our User Agreement, our Policies, and your fellow ServeBartendCook Members.

 

C. Your Obligations

 

As a Member, you have certain obligations to other Members. Some of these obligations are imposed by applicable law and regulations and others have become commonplace in communities of like-minded Members such as ServeBartendCook:

 

  • You must, at all times, abide by the terms and conditions of the current Privacy Policy, User Agreement, and other policies of ServeBartendCook. This includes respecting all intellectual property rights that may belong to third parties, such as trademarks or copyrights.
  • You must not upload or otherwise disseminate any information that may infringe on the rights of others or which may be deemed to be injurious, violent, offensive, racist, or xenophobic, or which may otherwise violate the purpose and spirit of ServeBartendCook and its community of Members.
  • You must keep your username and password confidential and not share it with others.

Any violation of these guidelines or those detailed in our User Agreement or elsewhere may lead to the restriction, suspension, or termination of your account at the sole discretion of SBC Industries, LLC.

 

4. Important Information

 

A. Changes to this Privacy Policy

We may change this Privacy Policy from time to time and changes are effective upon posting. Please check back frequently for updates as it is your sole responsibility to be aware of changes. We do not provide notices of changes in any manner other than by posting the changes at this website.

 

If you object to any of the changes to our terms and you no longer wish to use ServeBartendCook, you may terminate your account as set forth in the User Agreement. Unless stated otherwise, our current Privacy Policy applies to all information that we has about you and your account. Using ServeBartendCook after a notice of changes has been posted on this website shall constitute consent to the changed terms or practices.

 

We will not share any of your personal information with third parties for direct marketing.

 

B. Unsubscribe Policy

To unsubscribe from our email lists, a person must send an email to unsubscribe@servebartendcook.com. Our unsubscribe process impacts only the future delivery of electronic mailings disseminated by us on its own behalf. You may still receive electronic mailings sent on behalf of third parties and your personal information may still be shared with third parties for use in offline marketing and data appends, including email appends.

 

Unsubscribing from our electronic mailings will not automatically unsubscribe the information from third parties. Since third parties maintain separate databases from us you will need to unsubscribe from each source individually, if desired. This allows you the freedom to pick and choose which subscriptions to maintain and which to discontinue.

 

C.Your California Privacy Rights

A California resident who has provided personal information to a business with whom he/she has established a business relationship for personal, family, or household purposes (“California customer”) is entitled to request information about whether the business has disclosed personal information to any third parties for the third parties’ direct marketing purposes. In general, if the business has made such a disclosure of personal information, upon receipt of a request by a California customer, the business is required to provide a list of all third parties to whom personal information was disclosed in the preceding calendar year, as well as a list of the categories of personal information that were disclosed.

 

However, under the law, a business is not required to provide the above-described lists if the business adopts and discloses to the public (in its privacy policy) a policy of not disclosing customer’s personal information to third parties for their direct marketing purposes unless the customer first affirmatively agrees to the disclosure, as long as the business maintains and discloses this policy. Rather, the business may comply with the law by notifying the customer of his or her right to prevent disclosure of personal information and providing a cost free means to exercise that right.

 

We do not share information with third parties for their direct marketing purposes. Please note that whenever you opt in to receive future communications from a third party, including employers, your information will be subject to the third party's privacy policy. If you later decide that you do not want that third party to use your information, you will need to contact the third party directly, as we have no control over how third parties use information. You should always review the privacy policy of any party that collects your information to determine how that entity will handle your information.

 

California customers may request further information about our compliance with this law by e-mailing privacy@servebartendcook.com. Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through this e-mail address.

 

D. No Information Collected from Children.

We will never knowingly collect any personal information about children under the age of 18. If we obtain actual knowledge that we have collected personal information about a child under the age of 18, that information will be immediately deleted from our database. Because it does not collect such information, we have no such information to use or to disclose to third parties. We have designed this policy in order to comply with the Children's Online Privacy Protection Act ("COPPA").
